You must be of legal age to purchase vaping products in your province or territory to use this website and make purchases. Legal age is:

• 18 years old in Alberta and Quebec
• 19 years old in BC, ON, MB, NB, NL, NS, NT, NU, SK, YT
• 21 years old in Prince Edward Island

By accessing this website, adding products to your cart, or completing a purchase, you represent and warrant that you are of legal purchasing age in your province. Providing false information about your age is a violation of the Tobacco and Vaping Products Act (TVPA) and may result in order cancellation and reporting to appropriate authorities.

We reserve the right to cancel any order where we have reason to believe the purchaser is under the legal age.

• All prices are displayed in Canadian dollars (CAD) and include applicable excise duties
• Prices are subject to change without notice. The price at the time of order confirmation is the price you will be charged
• Product descriptions, specifications, and images are provided for informational purposes. Minor variations may exist
• Maximum nicotine concentration of 20 mg/mL applies to all products, per Health Canada's Vaping Products Nicotine Concentration Regulations
• We reserve the right to limit quantities or refuse orders at our sole discretion, including orders that appear to be placed by resellers
• All products are intended for personal use only. Resale of vaping products without a valid provincial retail licence is prohibited

• An order is confirmed when you receive an email confirmation from us. We reserve the right to cancel confirmed orders in cases of pricing errors, stock issues, or suspected fraud
• Payment is processed securely through Clover Ecommerce (PCI-DSS Level 1 compliant). We do not store your credit card information
• We accept Visa, Mastercard, and American Express
• All transactions are processed in CAD. Your card issuer may apply foreign exchange fees if your card is not CAD-denominated
• By submitting an order, you authorize us to charge your selected payment method for the order total including taxes and shipping

• We ship to all Canadian provinces and territories where the sale of vaping products is legal
• A valid government-issued photo ID may be required upon delivery to confirm legal age. If the recipient cannot verify their age, the parcel will be returned and the order refunded minus shipping costs
• Delivery times are estimates only and are not guaranteed. Freaky Vapes is not liable for delays caused by carriers, weather, customs, or circumstances beyond our control
• Risk of loss and title for products passes to you upon delivery to the carrier
• We ship within Canada only. We do not ship internationally or to the United States

• Unopened products in original sealed packaging may be returned within 10 calendar days of delivery for a full refund, minus original shipping costs
• Opened or used products cannot be returned for hygiene and safety reasons, except in cases of manufacturer defect
• Defective products (hardware/devices) may be exchanged within 30 days of purchase with proof of purchase and photos of the defect
• Damaged-in-transit claims must be reported within 48 hours of delivery with photos of the damage and original packaging
• To initiate a return, email support@freakyvapes.ca with your order number and reason for return
• Approved refunds are processed within 5–10 business days to the original payment method

You agree not to use this website or purchase products:

• If you are under the legal age in your province or territory
• To purchase on behalf of a minor
• For commercial resale without a valid provincial vape retail licence
• To circumvent provincial or federal restrictions on flavoured products by shipping to a non-restricted address for use in a restricted province
• In any way that violates the Tobacco and Vaping Products Act (TVPA), its regulations, or any applicable provincial law
• To engage in fraudulent or deceptive conduct, including providing false billing or shipping information
• To engage in any activity that disrupts or interferes with the operation of our website or servers

All content on this website, including text, images, product descriptions, logos, graphics, and the overall site design, is the property of Freaky Vapes or its content suppliers and is protected by Canadian copyright law. You may not copy, reproduce, distribute, or create derivative works without our express written permission. Product images and brand names belong to their respective manufacturers.

Products are sold “as is” and “as available.” To the fullest extent permitted by Canadian law, Freaky Vapes disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that our website will be uninterrupted, error-free, or free of viruses or other harmful components. Product descriptions are provided by manufacturers and we do not independently verify all claims.

Vaping and nicotine products carry health risks. By purchasing, you acknowledge that you understand these risks and assume full responsibility for your use.

To the maximum extent permitted by applicable Canadian law, Freaky Vapes, its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our products or website, including but not limited to health effects of vaping, allergic reactions, product malfunction, or delivery delays.

Our total liability to you for any claim arising out of or related to a purchase shall not exceed the amount you paid for the specific order giving rise to the claim.

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Any dispute arising from these Terms or your use of our website shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration or the courts of Ontario, as mutually agreed.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

We reserve the right to update these Terms at any time. The “Last updated” date at the top of this page will reflect changes. Your continued use of the website after any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
